The extended timeline to a June 2027 trial and pending pretrial motions explain trader expectations that Nicolás Maduro will not be convicted on every count. Defense counsel filed a September 2026 motion seeking dismissal on sovereign immunity grounds, arguing that acts alleged in the four-count narcoterrorism and cocaine-trafficking indictment occurred in his official capacity as Venezuela’s head of state. Oral arguments on those motions are scheduled for November 2026, and additional jurisdictional and statutory challenges remain. With the case still in early pretrial proceedings, historical patterns of lengthy litigation involving foreign officials and the high evidentiary threshold for proving all conspiracy elements further support the current market assessment that full conviction on every charge is unlikely.
