Virginia voters are scheduled to vote in the November 3, 2026 midterm elections on a constitutional amendment which, if passed, would establish a constitutional right to reproductive freedom in the state. This market will resolve to “Yes” if the Virginia Right to Reproductive Freedom constitutional amendment passes according to Virginia election procedure. Otherwise, this market will resolve to “No.” If this constitutional amendment is removed from the November 3, 2026 ballot in Virginia, this market will resolve immediately to “No.” If, for any reason, the results of this vote are not known by December 31, 2027, 11:59 PM ET, this market will resolve to “No.” This market will resolve based on the results of the vote according to a consensus of credible reporting. In case of ambiguity, this market will resolve solely based on official results reported by the Commonwealth of Virginia, specifically the Virginia Department of Elections (https://www.elections.virginia.gov/results/).Virginia voters will decide Question 1, the Right to Reproductive Freedom Amendment, on November 3, 2026. The measure, which passed both chambers of the General Assembly in consecutive sessions (2025 and 2026) after the intervening election, would enshrine protections for decisions on abortion, contraception, fertility care, and related services while permitting third-trimester regulations except when medically necessary to protect the patient’s life or health or when the fetus is nonviable. Multiple legal challenges to the ballot placement and language were dismissed by courts earlier in 2026. Early 2026 polling from sources including the Wason Center and Virginia Commonwealth University showed 61–66% support among registered voters, with stronger backing among Democrats, women, and Black voters. These factors, combined with Virginia’s status as the only Southern state without an abortion ban or early gestational limit, underpin the current trader consensus reflected in the 90.5% implied probability for passage.
